Is it a due process violation when a police officer issues a
summons that is not prior signed by a judicial officer of the court, the “Separation
Clause” provides the Legislative, Judicial, and Executive branches will be
separated. When an officer from the
executive branch sign’s and issues a citation it is a violation of the separation
clause of the constitution because the summons was Not signed by a “Judicial”
officer of the court. Right?
