Divorce Documents Top Paralegal Request For Assistance.

Divorce documents have been the top request from internet user's who are looking to save money by filing the proper paperwork themselves. Currently, there is no option for couples who have no property to divide and no children. These couples are forced to hire family court attorneys at a price of 3000.00 or more and these family attorney's print off the forms from the court website and fill out the forms and file them on your behalf. I have done some research on this issue and what I have discovered is very disturbing. Family court rules do not adhere to the constitution. In my opinion, these rules are designed to be mindful of the court time management and not the families. In some state's the party with the attorney can talk to the judge without the other parties knowledge and corrupt the judge's mind long before the hearing. It shocking that one could loose property and kids in "family court" and have their rights to due process violated by the court at the during the process.

Script For Traffic Court- This Blog Posting Will Help You Understand the Process in Traffic Court, Where The Pit Falls Are and How to Navigate Around Them.

The Script for Traffic Court Defense:

Traffic Court’s Goal

Traffic Court’s goal is to enter into a contractual agreement with you to make you pay them for the infraction they have accused you of violating. If you sign anything in court you are agreeing to be at their mercy. If you are asked how you plead and you respond “Not guilty” you will have just provided jurisdiction to the unlawful Municipal Court and also will have entered into a contractual agreement to pay the fine.

The Script for Traffic Court:

When the judge calls out your name you respond:

1. Please let the record reflect that I ‘m here under duress and I do not agree to any contractual agreements pertaining to this matter, and I’m not signing any forms here today.

When asked “how do you plead you will respond:

2. Sir, I waive the benefit of a plea today because I have been charged with violating a statute or code that does not contain the necessary elements required by the State of Arizona’s Constitution to be a law.

Without a valid law, the charging instrument is insufficient and no subject matter jurisdiction exist for the matter to be tried.

Where an information charges no crime the court lacked Jurisdiction to try the accused. See: People v. Hardiman, 347 N. W. 2d. 460, 462, 132 Mich. App. 382 (1984).

Laws in statute books without enacting clauses is not a valid publication of law.

I’m requesting this issue be dismissed.

3. More than likely the judge will enter a plea of “not guilty” on your behalf:

I would respond “great so the matter is settled right?” the judge will say excuse me, and you reply well sir, you are the judge and you just entered on the record that I’m not guilty so the matter is settled right and I’m free to go Right?

It is at this point I would start gathering up my paperwork to leave they will try and get you to sign to appear. When you tell them you are not agreeing to contract the judge will say something like your signature is not an admission of guilt, it just states that you will appear.

Your response would be, Sir, “to appear” in the Blacks Law dictionary means to provide jurisdiction to the court right?

At this point, they should just tell you when you need to return for your trial date once you have that date you should turn and leave. Notice I never responded to the guy as “Judge.”

Now the traffic court prosecutor will have to respond to your documents and then you will reply to his response. Each document you file the traffic court prosecutor has to respond to and you will get to reply. There may be a couple hearings on the motions they need to find out if you know your facts or if they can convince you that you’re pleading it garbage and should be denied. If you are called into court to hear your motion you want to make sure you refuse to argue with the prosecutor. Let them know from the beginning of the hearing that you will be standing on your pleading. This will force the traffic court prosecutor to argue against your pleading. They may wait until the last min. before they dismiss it… or they may cut their losses and at the arraignment (the 1^st court meeting) and say the officer is out on training and dismiss it there on the spot.

Asha Spaulding's Unlawful Civil Asset Forfeiture was Filed Against Her Bank Account And Her Money Was Seized Without Due Process

Nobody is willing to step up and accept responsibility for the unlawful seizure of Asha Spaulding’s bank account from the Geo Vista Credit Union. It would appear the conspirators who participated in the embezzlement of Spaulding’s bank account have decided to bury their heads in the sand, in hopes that Spaulding, will give up her quest for justice and accept their injuries caused by the theft of her bank account.

The attorney for the city of Statesboro Georgia, responded to Asha Spaulding's, request for a copy of the "Return of Service" to verify that she was served, and he was confused as to if those requested records should be exempt from a freedom of information act request. His response was silly, the requested documentation should be filed in Spaulding's civil asset forfeiture case already, and it should be a matter of public record.

The letter from the Statesboro’s attorney did not have a copy of the return of service in it because Spaulding was not served. The staff here at Advocates for Justice, have been investigating this case for quite some time now and we searched both data bases the State of Georgia, uses to store the notice of publication, and we were unable to come up with any evidence to support that the State of Georgia actually publicized any forfeiture notice as pertains to Spaulding’s Assets that were illegally seized.

The 2nd document that was mailed to Spaulding from the Statesboro city hall appears to be the Police officer's investigation report, which was not filed in the state case, and the top right hand corner of the page it will show the page numbers are not in sequence. It would appear the pages were randomly selected printed off and mailed to Spaulding, to quince her thirst and get her to sit quietly and forget about the money that was unlawfully taken from her bank account. It would appear the government was planning to avoid transparency and reporting the income to the IRS, by not following the new Georgia Asset Forfeiture laws, and the laws that require the process of service before property can be seized. Due process is violated when the court allows the forfeiture of property without proof of service.

Word is officers of the court in Statesboro, have made derogatory comments about Black American’s, alleged lower level of “sophistication,”  could this racist attitude be the driving factor behind in injustice Spaulding, has suffered because the State of Georgia, unlawfully seized her bank account without due process.

The court has ignored the documents that Spaulding, has filed on the record and has failed to call for an investigation. Spaulding, is filing her motion for emergency hearing on her restraining order, and she is filing a motion to Disqualify Judge John Turner, from her civil action, he is unfit to rule in this case, because Judge Turner, was the decision maker in the Asset Forfeiture case that violated Spaulding's right to due process.Spaulding, listed the names of everyone who signed documents in the unlawful State Forfeiture case. The conspiracy statutes will connect the liable parties together and everyone will share in the liability.

Spaulding, is in the process of filing a formal complaint requesting an investigation into embezzlement of her money, and she will also be filing her "Notice of Claim" against everyone listed in the document to disqualify the judge.

Spaulding, is also demanding the case be moved to the Chief Justice’s Court room in a different town because of the conspiracy and high level of corruption in Statesboro Georgia.

If the judge's butt will catch on fire they will settle! think about it.. they bust their asses to protect the judge! its their JOB, Number 1 job is to protect the Judge and the court! If you stomp on everything they will not want to go there! They will want to settle.

Carrie, I can’t go back to the old way of thinking and that way did not help you in your case for 8yrs, Carrie, if i put enough pressure on the judge and be a huge pain in his ass we will have a higher chance to get them to throw in the towel!

Remember we don't have a chance in hell of winning in a trial!!! So why would I need to worry about the judge. Dude the freaking Judge is NOT on my side, he is on their side., and he already hates me cause I’m black, lol.

The reason to post this is most of those people had nothing to do with the theft of her account and they will raise hell when they find out they have been added to the pot of liability!!!! Don’t you see. The problem is some of those people that were recently added to the list, you cannot get me to believe all of those people knew nothing about the fraud going on down there!
